{"id":4193,"date":"2019-09-16T20:24:54","date_gmt":"2019-09-16T23:24:54","guid":{"rendered":"http:\/\/www.delexodo.com.ar\/?p=4193"},"modified":"2019-09-16T20:25:00","modified_gmt":"2019-09-16T23:25:00","slug":"se-reglamento-en-entre-rios-la-figura-del-abogado-del-nino","status":"publish","type":"post","link":"https:\/\/www.delexodo.com.ar\/?p=4193","title":{"rendered":"SE REGLAMENT\u00d3 EN ENTRE R\u00cdOS LA FIGURA DEL \u201cABOGADO DEL NI\u00d1O\u201d"},"content":{"rendered":"\n<p>En reuni\u00f3n\nde Acuerdo General el Superior Tribunal de Justicia de Entre R\u00edos aprob\u00f3 la\nreglamentaci\u00f3n de lo dispuesto en el art\u00edculo 20\u00ba de la Ley Procesal de Familia\nN\u00ba 10.688. La misma institucionaliza en la provincia el derecho de asistencia\nletrada a ni\u00f1os, ni\u00f1as y adolescentes en contextos de vulnerabilidad o cuando\nlos mismos tengan intereses contrapuestos en los litigios con los de sus\nrepresentantes legales. Entre otros objetivos se busca garantizar el derecho de\ndefensa, la igualdad real de partes y el debido proceso, cumpliendo as\u00ed con las\nReglas de Brasilia, que garantizan el acceso de la justicia en especial a\npersonas en situaci\u00f3n de vulnerabilidad.<\/p>\n\n\n\n<p>La nueva Ley\nProcesal de Familia, para cumplir con las mandas del C\u00f3digo Civil y Comercial\nde la Naci\u00f3n y de la Ley de Protecci\u00f3n Integral de Derechos de Ni\u00f1os, Ni\u00f1as y\nAdolescentes estableci\u00f3 que el tribunal deb\u00eda reglamentar la figura de tutores\nespeciales y abogados especialistas.<\/p>\n\n\n\n<p>En el texto\naprobado se establece c\u00f3mo se confeccionar\u00e1n los respectivos listados de\nprofesionales, que estar\u00e1n a disposici\u00f3n en los Juzgados de Familia para\nasegurar la representaci\u00f3n o asistencia t\u00e9cnica, seg\u00fan el caso, de ni\u00f1os, ni\u00f1as\ny adolescentes. Y tambi\u00e9n l patrocinio gratuito de personas v\u00edctimas de\nviolencia familiar o contra la mujer en el \u00e1mbito dom\u00e9stico.<\/p>\n\n\n\n<p>El mecanismo\nestablecido es \u00e1gil y transparente, en consonancia con la naturaleza urgente\nque conllevan los asuntos judiciales en los cuales est\u00e1n involucrados derechos\nhumanos b\u00e1sicos.<\/p>\n\n\n\n<p>El STJER\ndispuso que el Colegio de Abogados de Entre R\u00edos llevar\u00e1 el registro de\nprofesionales habilitados para asistir a los intereses individuales de ni\u00f1os,\nni\u00f1as y adolescentes, ya sea como abogados especialistas o tutores especiales,\nsin perjuicio de la intervenci\u00f3n del defensor p\u00fablico en los respectivos\ntr\u00e1mites. Adem\u00e1s el Alto Cuerpo resolvi\u00f3 que abonar\u00e1 los honorarios\nprofesionales con recursos propios en caso de insolvencia comprobada judicialmente\nde los condenados en costas.<\/p>\n\n\n\n<p>Las abogadas\ny los abogados interesados en incorporarse al registro deber\u00e1n acreditar al\nmenos 80 horas c\u00e1tedras de capacitaci\u00f3n dictadas por el Instituto de Formaci\u00f3n\ny Perfeccionamiento Judicial \u201cDr. Juan Bautista Alberdi\u201d, dependiente del\nSTJER.
