{"id":3910,"date":"2019-08-22T19:35:19","date_gmt":"2019-08-22T22:35:19","guid":{"rendered":"http:\/\/www.delexodo.com.ar\/?p=3910"},"modified":"2019-08-22T19:35:19","modified_gmt":"2019-08-22T22:35:19","slug":"rechazaron-el-pedido-de-sobreseimiento-de-intendente-entrerriano-en-una-causa-por-supuesto-sobreprecio","status":"publish","type":"post","link":"https:\/\/www.delexodo.com.ar\/?p=3910","title":{"rendered":"RECHAZARON EL PEDIDO DE SOBRESEIMIENTO DE INTENDENTE ENTRERRIANO EN UNA CAUSA POR SUPUESTO SOBREPRECIO"},"content":{"rendered":"\n<p><strong>La causa\nlleva en los Tribunales dos a\u00f1os y medio.<\/strong><\/p>\n\n\n\n<p>Este mi\u00e9rcoles por la tarde, el juez de Garant\u00edas N\u00b0 3 de\nParan\u00e1, Ricardo Bonazzola rechaz\u00f3 el pedido de sobreseimiento de Cristian\nTreppo, intendente de Segu\u00ed, en el marco de una causa que investiga supuesto\nsobreprecio en la obra de 16 cuadras que se ejecut\u00f3 con fondos provenientes del\nplan nacional \u201cM\u00e1s Cerca\u201d.<\/p>\n\n\n\n<p>La causa fue impulsada a ra\u00edz de la denuncia de un bloque de\nconcejales de Cambiemos de la localidad. Aparentemente, la obra, que cost\u00f3 20\nmillones de pesos, estar\u00eda inflada entre los 9.5 y los 13 millones de pesos,\nseg\u00fan la Fiscal\u00eda.<\/p>\n\n\n\n<p><strong>Argumentos\ndel rechazo<\/strong><\/p>\n\n\n\n<p>El juez de Garant\u00edas consider\u00f3 que en el caso no procede el\nsobreseimiento porque no se dan las causales A, B y C que establece el C\u00f3digo\nProcesal Penal: no existe \u201ccerteza negativa\u201d respecto de que el hecho\ninvestigado no existi\u00f3, que el hecho no encuadra en una figura penal, y que el\ndelito no fue cometido por el o los imputado\/s.<\/p>\n\n\n\n<p>El letrado manifest\u00f3 en este sentido que \u201chabiendo analizado\nlos argumentos vertidos, y las evidencias obrantes en el legajo de Fiscal\u00eda, en\nparticular la pericia contable, tales evidencias no me permiten alcanzar una\nresoluci\u00f3n desincriminante con el convencimiento certero e indudable sobre su\nprocedencia\u201d. Asimismo, dej\u00f3 en claro que el Ministerio P\u00fablico Fiscal lleva\nadelante la acci\u00f3n penal y que reafirm\u00f3 su voluntad de seguir investigando.<\/p>\n\n\n\n<p>La Fiscal\u00eda pr\u00f3ximamente solicitar\u00e1 la \u201cremisi\u00f3n de la causa\na juicio\u201d, expres\u00f3 el juez, y a\u00f1adi\u00f3 que \u201clo que evidencia es que faltan\nelementos de convicci\u00f3n sobre el acaecimiento del hecho y la participaci\u00f3n\npunible que le cupo a los acusados\u201d.<\/p>\n\n\n\n<p>A su vez, el juez tambi\u00e9n descart\u00f3 que se haya violado el\nprincipio del plazo razonable en la investigaci\u00f3n, que fue planteada por el\nabogado de Treppo, Germ\u00e1n Coronel, con la adhesi\u00f3n de sus colegas. La causa\nlleva en los Tribunales dos a\u00f1os y medio.<\/p>\n\n\n\n<p>Por \u00faltimo, el magistrado tambi\u00e9n rechaz\u00f3 el cuestionamiento\nde los defensores a la calificaci\u00f3n legal, esto es, el supuesto delito de\npeculado. \u201cEn esta instancia, la misma resulta una imposici\u00f3n formal\u201d, dijo el\nmagistrado, que explic\u00f3 que en la instancia de la investigaci\u00f3n penal\npreparatoria no se exige que la imputaci\u00f3n est\u00e9 correctamente delimitada, sino\nque ello se analiza en la audiencia de elevaci\u00f3n de la causa a juicio.<\/p>\n\n\n\n<p>En la audiencia estuvieron el fiscal de la causa, Franco\nBongiovani; el abogado Germ\u00e1n Coronel, que defiende a Treppo; a Carina Zapata,\nla ingeniera en construcciones que fue contratada por el Municipio para\nproyectar la obra; y al contador municipal Dar\u00edo Alexis Monz\u00f3n. Y los abogados\nMiguel \u00c1ngel Cullen y N\u00e9stor Pedroti que defienden a An\u00edbal Heren\u00fa, titular de\nla empresa Organizaci\u00f3n Industrial Construcciones SA (OICSA), a quien se\nadjudic\u00f3 la obra; al ingeniero de la firma, Hern\u00e1n Barrera; y a N\u00e9stor Iv\u00e1n\nSzczech, vicepresidente segundo de la delegaci\u00f3n Entre R\u00edos de la C\u00e1mara Argentina\nde la Construcci\u00f3n.<\/p>\n\n\n\n<p>Fuente: Entre R\u00edos Ahora<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La causa lleva en los Tribunales dos a\u00f1os y medio.
